As the weather continues to get warmer, be prepared to see more motorcycles on the road. As motorists, it’s our responsibility to watch out for motorcycles. Many crashes occur because motorcycles are hidden in a vehicle’s blind spot. Drivers should always make a visual check for motorcyclists by checking mirrors and blind spots before entering or leaving a lane of traffic, The National Safety Council explained. Motorcycle safety also is an issue of increasing concern – fatalities involving drivers and motorcyclists increased 131 percent between 1998 and 2008, according to NSC.

Throughout the month of May, which is also Motorcycle Safety Awareness Month, NSC encourages motorists to share the road with motorcyclists and to be extra alert when they are nearby. NSC’s tips include:

Cars
1. Must allow greater following distance behind a motorcycle.
2. Drivers also must show extra caution in intersections. Most crashes occur when a driver fails to see a motorcyclist and turns left in front of a motorcycle.
3. Drivers should never try to share a lane with a motorcycle. Always give a motorcycle the full lane width.

To better defend themselves, motorcyclists should follow the rules of the roadway and wear protective gear such as a helmet, the proper jacket, and correct eyewear.

Motorcycles
1. Should avoid riding in poor weather conditions.
2. Should position their motorcycles to avoid a driver’s blind spot.
3. Must use turn signals for every turn or lane change.

So when and how do crashes like these turn into a criminal case? Unlike a case of drunk driving, or other negligent activity, diabetes and other medical causes are hard to prove. Dan Davis is with Davis & Gelshenen law firm in Milwaukee.

He explains, “When it’s caused by something like illness without forewarning, it can be be more traumatic because there’s nobody to blame.”

What to Do After a Car Accident

A car accident can be a very traumatic event.  Stress and injuries may affect your ability to think clearly.  How you react to the accident and the information that you obtain can be a critical element in your case.  After an accident:

  1.       Be careful.  If you are in severe pain, wait for paramedics to arrive to assess your injuries.
  2.      Speak with other drivers and witnesses involved only to obtain names, addresses and telephone numbers.  Do not discuss the accident with other drivers or witnesses.
  3.      Make sure that you acquire each driver’s automobile insurance information including the name of the person insured on the vehicle, the company’s name and telephone number if known.
  4.      Contact the police to make an immediate report of the accident and remain at the scene until after an officer arrives.
  5.       Cooperate with the police in preparing an accident report.  After the accident, photograph the exterior and interior of the vehicles involved in the accident.
  6.       Do not fill out or sign any insurance documents, or provide recorded statements without first consulting with a lawyer.
  7.       If injured, consult with a physician as soon as possible.

Should you contest an accident-related traffic citation?

If you are involved in an automobile accident and receive a citation, but you don’t believe the accident was your fault should you contest the ticket?

Ultimately, the decision is yours.  Some questions to consider are:  What are your chances of success if you do contest it? How much will it cost you?  Will you lose your driving privileges?  A lawyer can help you assess your situation.

If you decide to contest the citation, you are entitled to a trial.  If the case is to be resolved in municipal court, a judge will decide the matter.  If the case is to be resolved in circuit court, a judge also will resolve it, unless you immediately request a jury and pay the required fee.

If you decide that you do not want to contest the citation, and if someone else’s person or property was injured as a result of the accident, you should plead “no contest” rather than “guilty.”  A no contest plea, unlike a guilty plea, can’t be used against you later in a lawsuit.

Revised Recommendations on Child Safety Seats

The new guidelines, released by the American Academy of Pediatrics (AAP) and the National Highway Traffic Safety Administration (NHTSA), were created through a better understanding of what keeps children safe in car accidents.

Former guidelines

  • Under 1 Year: Rear-facing car seats
  • Ages 1-4: Forward facing with a five point harness
  • Ages 4-8: Booster seat

New Guidelines

  • Under 1 Year: Rear-facing car seats
  • Ages 1-3: Children should stay in rear facing car seats as long as possible.   Once the weight and/or height limit is reached, the child should be placed in a forward-facing seat with a five point harness.
  • Ages 4-7:  Children should remain in the five point harness until the maximum weight or height has reached its limit. Once the limit is reached, the child should be placed in a belt-positioning booster seat.
  • Ages 8-12: Children should not be placed in a regular seat until the seatbelt properly fits snuggly across the upper thighs, not the stomach.  The shoulder belt should lie snug across the shoulder and chest and not cross the neck or face.  This will be possible when the child has reached approximately 4’9”.
  • Up to age 13:  Children should stay in the back seat until they are at least 13 years of age.
