Should you contest an accident-related traffic citation?

If you are involved in an automobile accident and receive a citation, but you don’t believe the accident was your fault should you contest the ticket?

Ultimately, the decision is yours. Some questions to consider are: What are your chances of success if you do contest it? How much will it cost you? Will you lose your driving privileges? A lawyer can help you assess your situation.

If you decide to contest the citation, you are entitled to a trial. If the case is to be resolved in municipal court, a judge will decide the matter. If the case is to be resolved in circuit court, a judge also will resolve it, unless you immediately request a jury and pay the required fee.

Revised Recommendations on Child Safety Seats

The new guidelines, released by the American Academy of Pediatrics (AAP) and the National Highway Traffic Safety Administration (NHTSA), were created through a better understanding of what keeps children safe in car accidents.

Former guidelines

Under 1 Year: Rear-facing car seats
Ages 1-4: Forward facing with a five point harness
Ages 4-8: Booster seat

New Guidelines

Under 1 Year: Rear-facing car seats
Ages 1-3: Children should stay in rear facing car seats as long as possible. Once the weight and/or height limit is reached, the child should be placed in a forward-facing seat with a five point harness.
Ages 4-7: Children should remain in the five point harness until the maximum weight or height has reached its limit. Once the limit is reached, the child should be placed in a belt-positioning booster seat.
Ages 8-12: Children should not be placed in a regular seat until the seatbelt properly fits snuggly across the upper thighs, not the stomach. The shoulder belt should lie snug across the shoulder and chest and not cross the neck or face. This will be possible when the child has reached approximately 4’9”.
Up to age 13: Children should stay in the back seat until they are at least 13 years of age.

Is Your Child Safe on a School Bus?

According to the National Safety Council, 22 million students across the country begin and end their school day with a trip on a school bus. Most parents put their kids on school buses without thinking twice about safety. Surprisingly, most safety related problems involving buses tend to occur outside of the bus. In fact, almost 2/3 of school bus related fatalities occur outside of the bus itself. Following are some key points to teach your children to insure their safety both on and off the bus:

Children should wait away from the roadway and board only when the bus has come to a complete stop.
When crossing in front of the bus, children should walk at least 10 steps away from the bus so the driver can see them.
Children should never walk behind the bus. Drivers can lose sight of kids in blind spots.
Children should always stay seated and face forward with feet on the ground.
Children should place book bags under their seats or under the seats in front of them
Children should never throw things on a bus. If something were to hit the driver it could cause the driver to lose control of the bus.
If a child drops something under or nearby a bus, the driver should be informed before anyone tries to pick it up. If the driver is not informed, he or she may begin moving the bus while a child is in harm’s way.
When it’s icy outside, children should be sure to walk slowly and carefully around the bus, and ALWAYS walk with someone. This way if a child falls, someone is there to inform the bus driver.

Do You Understand Automobile Insurance Coverage?

Comprehensive insurance covers your vehicle if it is damaged in a way not related to its operation, e.g. by hail, wind, vandalism, etc. Liability insurance is perhaps the most important, because it protects you if you are sued due to an accident that is your fault. Medical Payments insurance will cover medical expenses related to a motor vehicle accident. Uninsured Motorists coverage is extremely important. Uninsured Motorist insurance protects you when you are involved in an accident with a motorist who doesn’t carry insurance. Similarly, and arguably more important, is Underinsured Motorist coverage. This protects you when you are involved in an accident with a motorist who doesn’t carry enough insurance (which comprises most drivers).

Install Child Safety Seats Correctly to Avoid Injury

According to the National Highway Traffic Safety Administration (NHTSA), three out of four child safety seats are not used correctly. As a result, thousands of children are injured or killed each year because they are not properly secured in their seats. The LATCH (Lower Anchors and Tethers for Children) system has made installing child safety seats easier and safer. LATCH is required on all child safety seats and most vehicles manufactured after September 1, 2002. How to install a safety seat using the LATCH system:

• ALWAYS read and follow the vehicle owner’s manual and child safety seat manufacturer’s instructions for correct installation and proper use.

• Fasten the child safety seat’s lower attachments to the vehicle’s lower anchors. Tighten and adjust according to the instructions and check for a secure fit.

• Attach the Child safety seat’s top tether to the vehicle’s anchor and pull to tighten. The child safety seat should not move more than an inch forward or sideways. NOTE: Tethers are not used on most rear-facing child safety seats.

Thirty-Six Million Pounds of Turkey Recalled After Recent Salmonella Bacteria Outbreak

On Wednesday, August 3, 2011, CNN News reported a Salmonella bacteria outbreak that contaminated 36 million pounds of ground turkey meat (same weights as 36 fully-loaded Boeing 747 commercial airplanes) from Cargill Meat Solutions Corporation. Cargill’s plant in Springdale, AR, processed the contaminated fresh and frozen ground turkey products between February 20 and August 2. One person has been killed, and 76 others in 26 states have been sickened due to ground turkey products. Consumers are being encouraged to return any opened or unopened packages for a full refund. Other turkey products from Springdale are not affected by the recall. Nor are products from Cargill’s three other turkey processing facilities in the United States. Joel Brandenberger (President of the Washington-based National Turkey Federation) predicted the recall will have little impact on turkey consumption. “The fact that the government and everybody involved worked through this issue pretty quickly to resolve it will maintain consumer confidence in ground turkey”.
